‘Living together shamelessly without marriage…’, Uttarakhand High Court raises questions on live-in partner’s petition

The Uttarakhand High Court questioned the petition filed against the mandatory registration of live-in relationships. The court asked, if couples are living shamelessly without marriage, then how is registration a violation of privacy? The petitioners talked about an attack on privacy. The court will hear the case on April 1.

Nainital: When couples are “shamelessly” living together without marriage, how is registration violating their privacy, the Uttarakhand High Court has asked while hearing a plea challenging the mandatory registration process of live-in relationships under the state’s Uniform Civil Code.

While hearing the petition, the High Court bench of Chief Justice G Narendra and Justice Alok Mehra said, “You are living in society, not in a remote cave in the forest. From neighbors to society, you have relatives and you are living together without marriage. Then how can the registration of live-in relationship violate your privacy?

Difficulty may arise for couples in future

The lawyer of the petitioners said that many live-in relationships have turned into successful marriages and this provision hinders the future and privacy of the couples. On the PIL and other petitions, the court directed that people dissatisfied with the UCC can knock the door of the High Court.

Petitioner’s lawyer Abhijay Negi said that we have seen in India what has happened to some inter-religious couples. A youth named Jagdish was murdered in Almora district just because he was part of an inter-religious couple.

Now the case will be heard in April

The court will now hear this case on April 1 along with other similar petitions. This move of the court has further heated up the public discussion going on around the controversial UCC in the state. It will be interesting to see what new arguments come up in the upcoming hearing and what is its result. –
